Legal Separation Vs. Divorce
For some married couples, a legal separation is preferential to a divorce. Couples may seek a legal separation as opposed to a divorce because of religious reasons or financial reasons. In some cases, husbands and wives want a legal separation but do not want a divorce because a divorce may have a negative impact on medical insurance, government benefits, or taxes.
Legal Separation in Illinois
In Illinois, a legal separation is similar to a divorce. In a legal separation, the court has a right to determine issues of child custody, visitation, support and spousal maintenance (alimony). The court may not divide property, unless the parties agree. However, even in the absence of an agreement between the parties, the court can grant temporary use of property, including the family home or vehicles.
