Most people are familiar with prenuptial agreements. By contrast, the concept of a post-nuptial agreement is not as widely known.

A post-nuptial agreement is very similar to a prenuptial agreement, with the exception that it is an agreement entered into by a couple after marriage. Just as in the case of a prenuptial agreement, both parties entering into a post-nuptial agreement should have legal representation, as a party seeking to oppose the enforcement of a post-nuptial agreement may argue that the agreement was not entered into knowingly in the absence of legal counsel.

The Purpose of a Post-Nuptial Agreement

In the midst of preparing for a marriage, many couples that have considered the possibility of a prenuptial agreement merely run out of time. In the midst of wedding plans, things can get hectic.

A post-nuptial agreement can provide all of the same protections offered by a prenuptial agreement. Typically, parties entering into a post-nuptial agreement want to clarify their rights and obligations in the event of a divorce. Property division issues are often at the forefront of consideration, but other issues, like spousal support, may also be a focus of the agreement.
